Ash Pay
These Terms of Service ("Terms") govern your use of the Ash Pay mobile app and website at getashpay.com (the "Service"), provided by Ash Creative Labs ("Ash Pay," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use Ash Pay. By using the Service, you confirm that you meet these requirements and that the information you provide is accurate.
2. The Service
Ash Pay is a mobile money-transfer and digital wallet service that lets you hold a balance, send and receive money with other users, request payments, and — through trusted partners — arrange cash pickup or ATM cashout. Features may change, expand, or be limited over time.
3. Your account
- You are responsible for the accuracy of your account information and for keeping your PIN and device secure.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@getashpay.com if you suspect unauthorized use of your account.
4. Transfers and accuracy
You are responsible for making sure the recipient details you enter are correct before you send money. Transfers between Ash Pay users are intended to settle promptly. Because you are directing the transfer, you should double-check the recipient, as completed transfers may not be reversible.
5. Acceptable use
You agree not to use Ash Pay to:
- Break any law or fund any illegal activity, including fraud or money laundering.
- Send money you are not authorized to send, or impersonate another person.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with, disrupt, or misuse the Service.
6. Fees
Any fees that apply to a transaction will be shown to you before you confirm it. Your mobile carrier's message and data rates may also apply to text messages, as described in our Messaging Policy.
7. Third-party services
Ash Pay relies on third parties — including cloud infrastructure, messaging providers, app stores, and exchange or cash-out partners — to deliver the Service. Your use of those services may be subject to their own terms, and we are not responsible for their acts or omissions.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure at all times.
9. Limitation of liability
To the fullest extent permitted by law, Ash Pay and Ash Creative Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.
10. Indemnification
You agree to indemnify and hold harmless Ash Pay and Ash Creative Labs from any claims, losses, or expenses arising out of your use of the Service or your violation of these Terms.
11. Suspension and termination
We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or to protect the Service and its users. You may stop using the Service and request that we close your account at any time.
12. Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you in the app. Continued use of the Service after an update means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules.
